1. Acceptance of Terms
By booking a session, accepting a quote, or accessing delivered images, you agree to these Terms of Service.
CORPORATE & COMMERCIAL PHOTOGRAPHY TERMS
These terms apply to corporate headshots, team photography, branding sessions, commercial campaigns, and business marketing projects.
2. Booking & Payment
A booking is confirmed once the booking fee has been paid.
Booking fees are non-refundable.
The remaining balance must be paid prior to image delivery unless otherwise agreed in writing.
Nicoline Dickinson Photography reserves the right to withhold image delivery until full payment has been received.
All pricing is exclusive of GST unless otherwise stated.
3. Cancellations & Rescheduling
Client Cancellation
Cancellations within 24 hours of the scheduled session may incur a cancellation fee.
Booking fees are non-refundable but may be transferred at the photographer’s discretion.
Cancellations within 12 hours may incur the full reserved time charge.
Photographer Cancellation
If the photographer is unable to attend due to illness or emergency, liability is limited to refunding fees paid.
4. Image Delivery & Editing
Final edited images are delivered digitally.
RAW files are not supplied.
Editing style and artistic direction remain at the photographer’s discretion.
Turnaround times are estimates and may vary during peak periods.
5. Data Retention & Gallery Expiry
Standard Data Retention Period: 1 Month (30 Days)
Galleries and digital files remain available for 30 days from delivery unless otherwise agreed in writing.
After 30 days, files may be permanently deleted from active systems and backups.
Long-term storage is not guaranteed.
Clients are fully responsible for downloading and securely backing up images within this period.
File recovery after deletion is not guaranteed and may incur administrative fees.
6. Corporate Licensing & Usage
All images remain the intellectual property of Nicoline Dickinson Photography.
Upon full payment, corporate clients receive a non-exclusive license for:
Website use
Social media
LinkedIn profiles
Internal marketing
Print marketing
Company presentations
Unless agreed in writing:
Images may not be resold or sublicensed.
Images may not be altered beyond basic cropping or resizing.
Major advertising campaigns or third-party commercial usage require extended licensing.
7. Confidential & Corporate Work
If the project involves:
Confidential information
Product launches
Sensitive company material
A written confidentiality agreement must be arranged prior to the shoot.
8. Marketing & Portfolio Use
Unless agreed otherwise in writing, Nicoline Dickinson Photography reserves the right to use images for:
Website
Social media
Portfolio
Promotional material
Corporate clients may request exclusion prior to the shoot.
9. Limitation of Liability
Liability is limited to the amount paid for the session.
Nicoline Dickinson Photography is not liable for indirect, consequential, or reputational loss arising from image use.
REAL ESTATE PHOTOGRAPHY ADDENDUM
The following terms apply specifically to real estate photography services.
1. Property Readiness
The property must be fully prepared, cleaned, and decluttered prior to arrival.
The photographer is not responsible for moving heavy furniture, cleaning, or staging unless agreed in writing.
Time spent waiting for preparation may reduce shooting time.
2. Image Usage – Real Estate
Purchased real estate images include a limited marketing license for:
One property listing
One agency campaign
Marketing of that property only
Images may not be reused for future listings, builders’ portfolios, or commercial promotions without additional licensing.
3. Drone Photography
Where drone photography is included:
Flights are subject to weather conditions and Civil Aviation Authority regulations.
If unsafe to fly, drone services may be rescheduled or refunded.
Boundary lines and overlays are approximate visual guides only and not legally surveyed boundaries.
4. Virtual Staging & Editing
Virtual staging is charged per image.
Digitally altered images must comply with current real estate advertising standards.
The photographer is not responsible for misuse of altered imagery by third parties.
5. Data Retention – Real Estate
Real estate galleries remain active for 30 days from delivery.
After 30 days, files may be permanently deleted.
Agents are responsible for downloading and securely storing all marketing images within this timeframe.
6. Scheduling & Access
Access to the property must be arranged by the agent.
The photographer is not responsible for denied entry or lockbox issues.
Reattendance due to access issues may incur additional charges.
Governing Law
These Terms of Service are governed by the laws of New Zealand.
